Chapter 7 Bankruptcy in 7 easy steps

  2. You will need to provide the following documents prior to filing:copy of your driver’s license or legal identification;copy of your social security card;

    copy your last two (2) years federal and state income tax returns;

    copy of all checking and savings accounts and investment accounts for one year;

    three months of payroll or income verification;

    up to date credit report;

    credit counseling certificate (your attorney will educate you on the simple online classes you will need to take prior to filing and your discharge).

  3. Simple and easy filing – In most cases you can expect the Chapter 7 process to take approximately 4 months, but remember you are protected from creditors as soon as your case is filed.
  4. 30-60 days after filing the debtor and attorney will attend a “Meeting of Creditors”. At this time, a trustee that has been assigned to your case by the court will ask you a series of questions. Normally this is a short process and the trustee is specifically looking for non-exempt assets and or any other legal issues with your cases. Your attorney is mindful of many questions the trustee may have and in most cases will have gone over them with you. You may be thinking that going to court can be a very scary experience.
